Lukoton – terms and conditions
1. General
This application is maintained by Lukoton Experience Oy (“Lukoton”).
For the use of this application, the user receives required access rights from the company or community, which maintains the premises where locked doors may be opened by using this application. In order for the user to receive access rights, the company or community in question will require that the user submits his or her mobile phone number and other relevant personal data.
For the use of this application, the user must be 16-years old. In case the user is under 16 years old, the use of this application requires a consent submitted by guardian.
By installing or using this application, the user agrees to be bound by these terms and conditions.
Lukoton may update or amend these terms and conditions at any time without a prior notification. By using this application, after updates or amendments to these terms and conditions, the user shall be considered as having accepted such updates or amendments.
2. Intellectual property
All intellectual properties relating to the items or contents of the application belong to Lukoton. The user may not edit, modify, duplicate, publicly display or transfer any items or contents that are subject to intellectual property rights protection.
The user’s right to use the application is restricted only for personal use.
3. Costs
While using the application, the user is responsible for all costs related to user’s devices and telecommunications. In addition, the user is responsible for data transfer costs and other costs related to the use of the application.
4. Personal access rights
Access rights provided to the user, for the use of the application, are personal. The user may only use the application in accordance with these terms and conditions and other relevant instructions provided. The user shall have the right to use the application only for personal use. The user shall be liable for all actions taken in connection to the usage of the application.
5. Availability
The application is provided for the user as such. The application may at times be out of service or the functioning of the application may temporarily be hindered by maintenance work.
Lukoton shall not provide any guarantees to the user over the functioning of the application or the service provided through the use of the application. Lukoton reserves the right to modify or disable the application at any time without a separate notification.
The application, its functioning or some its features may be dependent on the compatibility of devices, network connections and content formats.
6. Cookies and location data
Lukoton or third parties may use cookies and other analytical techniques to collect, use, save and transmit technical and other data. In relation to cookies, no personal data, from which the user could be identified, is collected from the users. Data collected by using analysis software’s may be used to develop the application.
As a technical requirement for the use of the application in Android devices may be that the user grants access to location data. The users using the application in Android devices are recommended to turn off location data where the user no longer needs the application for the purposes of opening doors.
7. Processing of personal data
In order to use the application as well as within the use of the application, the following personal data concerning the user are collected: User’s name, mobile phone number, mobile phone model and operating system, mobile phone subscription ID, door opening history and information on support requests. In relation to the above mentioned personal data collected from the user, the data controller, as defined according to applicable legislation, is the company or community that has provided access rights to the user. In relation to the personal data collected from the user, Lukoton, as defined according to applicable legislation, acts as a data processor by processesing personal data on behalf of the data controller.
As set out in section 6, the use of the application in Android devices may require that location data is collected from the user. Neither Lukoton nor the company or community that has provided access rights to the user acts, in relation to location data, as a data controller or a data processor. The relevant data controller in relation to location data collected from the users is the company or community that maintains and develops Android operating system.
The relevant data controller is liable for ensuring that the processing of personal data takes place in accordance with applicable legislation. The data controller is liable for ensuring that the user receives information on the processing of his or her personal data in accordance with applicable legislation.
8. Liability
Lukoton shall not be liable towards the user, the community that represents the user, or third parties for any direct or indirect damages suffered, as a result of the application or the use of the application. The user shall be liable for possible abuses of the application.
9. Applicable law and dispute resolution
The laws of Finland shall be applied in relation to these terms and conditions, subject to exception where the provisions on the choice of law determines differently. Possible disputes shall be resolved in the district court of Helsinki.
